Set up to say yes

People with disability are over-represented at every stage of the WA justice system, and the point where most things fall apart is release: no housing, no supports in place, conditions nobody explained, and a provider list that says no.

Prevail Care was set up to say yes. Our parent company is Care and Reintegration Pty Ltd; reintegration is the reason we exist. We deliver NDIS supports across Perth for participants on bail, parole and community orders, for people under supervision after a finding of mental impairment, and for those leaving prison, youth detention or a disability justice facility.

Every worker on a justice roster is trained in trauma-informed practice and in the participant’s behaviour support plan where there is one. The management team knows how courts, Corrections and the NDIA actually interact, because that is where our directors came from.

What justice support looks like in practice

It is the same NDIS supports as anyone else’s, delivered in a way that works for someone under an order.

  • Pre-release planning. Working with the prison transition team, lawyer, Community Corrections officer and support coordinator so housing, ID, Centrelink, medication and a roster are in place for the day of release.
  • Supported Independent Living. A home leased and set up to match the conditions of the order, including curfews and exclusion zones, with a roster built around them. How our SIL works.
  • Daily and community support. Workers who get the participant to reporting, court, legal appointments, programs and treatment on time, and who help build the ordinary week that keeps people out of trouble.
  • Working to the behaviour support plan. Where restrictive practices are authorised they are used only as authorised and reported to the NDIS Commission.
  • Records that stand up. Attendance, incidents and shift notes written so a lawyer, a Corrections officer or a review board can rely on them, shared only with informed consent or as the law requires.
  • Staying on when things go wrong. A breach, an arrest or a relapse does not end the service. We work the problem with the participant and the people around them.

★★★★★

“They are respectful, professional and overall my top pick for NDIS services for support workers. … They work hard to find the right fit for my needs as a person living with multiple disabilities. … The efforts I have seen have made it a really clear decision to stick with them as a service.

How the NDIS and the justice system fit together

The NDIS does not fund supports while a person is in custody; that is the state’s responsibility. It does fund planning for release, and it funds the supports a participant needs in the community, including supports that help them meet an order where the need arises from their disability.

A person who did not have a plan before custody can apply from inside, and the NDIA has justice liaison officers to help. Supports that are Corrections’ responsibility, such as supervision and offender programs, stay with Corrections. Getting that boundary right in the plan is half the work, and we help coordinators with the evidence.

Why providers say no, and why we don’t

Most providers decline forensic referrals because of staff safety, reputational risk and paperwork. We manage the first with assessment, two-worker shifts where warranted, training and a manager on the duty phone; the second by doing the work well; and the third by having done it many times.

We also know what we cannot do. We are not a secure facility, we do not supervise orders, and we will not accept a placement where the risk assessment says the home cannot be made safe.

Questions referrers ask

We assess every referral individually. The offence is one factor; current risk, supports and housing are the others. We say yes to many referrals other providers decline, and no where we cannot make it safe.

Yes, if we are involved early enough. Four to six weeks before release is workable; longer is better. In urgent cases we can usually have in-home or community supports running within 3 to 7 days.

Yes. We set out the supports we would deliver, the roster and the home, so the court can see what the community arrangement is.

We help the coordinator or lawyer with the access request and the evidence. We cannot deliver funded supports until there is a plan.

Workers support you to meet your conditions. We share information only with your informed consent or where the law requires it, and we explain what that means before you sign.

Yes. We support children, young people and adults, including young people leaving detention.

No. Supervision stays with Community Corrections. We deliver the disability supports that help a person live in the community and meet their conditions.
